The definition of rna_AnimData_action_get() is ifdef'd on WITH_ANIM_BAKLAVA, but it's use here doesn't appear to be ifdef'd. Is that a problem?

Fix: key insertion sometimes treats layered actions as legacy actions

No, this doesn't need a backport. This is only relevant when you already have layered actions in the scene, which can only be created via an experimental feature right now.
