Short description of error
To reproduce:
Clean file
Create an empty, create cube, parent cube,
Now try to append theese objects to another file.
All will work well. Until you add driver to emty`s transforms.
So add driver to empty transform (i made rotation from current_frame)
Try to append again. Blender will create whole new scene and place driven empty and cube there, instead main scene and active collection.

Here how it happens
Hi! I believe this is working as expected. Since the driver is referring the
frame_current
property from the "Scene" scene, then the empty has a dependency on "Scene" (otherwise it doesn't). So you can choose to use "Context property" mode for the driver variable, this way it will keep the reference to "Active Scene" instead of any specific scene, and this way you can append these objects without including the "Scene" scene.Thanks for reporting, will close this issue :D
Thanks, i tested. Even if i use Active scene, blender do the same: creates new scene after append.
So is there a way to append to current scene?
For some reason it doesn't seem to append correctly now but it was working, let me check further.
OK here I'm able to append without creating a new scene:
This seems pretty weird.
So I agree it can drag additional scene, when driver use exact scene, but in case of context/active scene it should be inserted right here, into active one.
You can see it is simple real case, where i want to append empty for fast turntable.
